Subpoenas: Interface Between Clinical Social Work And The Family Court

Subpoenas are one of those things most Clinical Social Workers hate about private practice. As Clinical Social Workers we have certain rights and responsibilities that are worth knowing. In order to understand these rights and responsibilities it is best to 1) review the MO Statutes regulating discovery, 2) understand the audience and expectations, 3) be aware of legal obligations, and 4) be aware of ethical obligations. Objectives: Attendees will be able to identify 1) the legal authority for subpoenas and subsequent Motions, 2) the role of discovery in the family court as it relates to Social Work documentation, 3) the capacities and expectations of agents of the family courts, 4) legal and ethical obligations of documentation, and 5) additional ethics issues when exposed to court-involved treatment.
